1. Definitions

• "Services" means the Campsites UK website, mobile applications, booking platform, owner dashboard, and any related tools or features provided by us.
• "User", "you", or "your" refers to any individual or entity accessing or using our Services, including campers, guests, and park owners.
• "Park Owner" refers to any individual or entity that lists a camping, touring, caravan, glamping, or holiday park on our platform.
• "Content" means any text, images, data, software, or other materials made available through our Services.

2. Eligibility

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you have the legal capacity to enter into a binding agreement and that your use of the Services will comply with all applicable laws and regulations.

3. Account Registration

Certain features of our Services may require you to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your account credentials confidential and secure
• Notify us immediately of any unauthorised access to or use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, incomplete, or fraudulent.

4. Acceptable Use

You agree not to use our Services to:

• Violate any applicable law, regulation, or third-party rights

• Post false or misleading park listings, reviews, or availability information
• Interfere with or disrupt the integrity or performance of our Services
• Attempt to gain unauthorised access to our systems or networks
• Use automated tools, bots, or scrapers without our prior written consent
• Circumvent the platform to complete bookings directly and avoid service fees
• Engage in any activity that could damage, disable, or impair our Services

5. Park Owner Obligations

If you are a Park Owner using our platform, you additionally agree to:

• Provide accurate and up-to-date listing information, including pricing, availability, facilities, and photographs
• Honour all bookings confirmed through the platform
• Comply with all applicable UK laws, including health and safety regulations, planning permissions, and licensing requirements
• Handle guest personal data in accordance with the UK GDPR and our Data Processing Agreement
• Respond to guest enquiries and booking requests in a timely manner
• Maintain appropriate insurance for your park and its operations

6. Bookings and Payments

• Bookings made through Campsites UK constitute a contract between the guest and the Park Owner. Campsites UK acts as an intermediary platform and is not a party to the booking contract.
• All fees are quoted in GBP (£) and are inclusive of VAT where applicable.
• Payments are processed securely through our third-party payment provider. Funds are transferred to the Park Owner's designated bank account in accordance with our payout schedule.
• Cancellation and refund terms are set by the individual Park Owner and displayed at the time of booking. Where no cancellation policy is specified, the Consumer Rights Act 2015 applies.
• Campsites UK subscription fees are billed monthly and are non-refundable except where required by law.

7. Intellectual Property

All content, trademarks, logos, and intellectual property displayed on or through our Services are owned by or licensed to Hale Technology Limited. You may not reproduce, distribute, modify, or create derivative works from any of our content without our prior written permission.

By submitting content through our Services (including park listings, photographs, and reviews), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display such content solely for the purpose of providing and improving our Services.

8. Third-Party Services

Our Services may contain links to or integrate with third-party websites, services, or content (including payment processors, mapping services, and analytics providers). We do not control and are not responsible for the availability, accuracy, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and policies.

9. Limitation of Liability

To the fullest extent permitted by law:

• Our Services are provided "as is" and "as available" without warranties of any kind, whether express or implied
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services
• We are not liable for the condition, safety, legality, or suitability of any park listed on our platform
• Our total liability to you for any claims arising out of or relating to these Terms or our Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Hale Technology Limited, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of our Services, your violation of these Terms, or your violation of any rights of another party.

11. Termination

We may suspend or terminate your access to our Services at any time, with or without cause, upon reasonable notice. Upon termination, your right to use our Services will immediately cease. Sections that by their nature should survive termination shall continue to apply.

You may terminate your account at any time by contacting us or using the account settings functionality. Park Owners must ensure all outstanding bookings are fulfilled before account termination.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also have the right to use the UK's alternative dispute resolution mechanisms.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or by posting a prominent notice on our website. Your continued use of our Services after such changes constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, GDPR Compliance Policy, and any other referenced policies, constitute the entire agreement between you and Hale Technology Limited regarding the use of our Services.
